MEDICAL BIRTH INJURY

What does the term ‘Birth Injury’ refer to?

A Medical Birth Injury is an injury caused to the mother or baby before, during or after the childbirth process – in this case due to a failure by the medical staff to provide the required and appropriate treatment and care.

What could be considered as a Birth Injury?

Examples of a Medical Birth Injury (in the case of the baby) could be:

  • Cerebral Palsy

  • Stillbirth

  • Erb’s Palsy

  • Complications due to Lack of Oxygen

  • Broken bones

  • Serious infections such as Group B Strep*

*Group B Strep is a type of bacteria called Streptococcus. It is very common, with as many as 2 in 5 people having it in their bodies. Whilst it is usually harmless (and most people who have it won’t actually know), it can be a problem during pregnancy and childbirth and there is a small risk of it spreading to the baby during labour, making them very ill.

How do I know if I have a claim?

It goes without saying that you and your baby should be taken care of during childbirth. If, however, mistakes have been made or standards have been very poor and an injury has been sustained, it is highly likely that the medical professionals failed to meet their Duty of Care. A call to our experienced Birth Injury experts will establish if you have been failed by those who cared for you, and if you have a valid claim to compensation.

Making a Claim

How do I make a claim?

Simply by contacting us at the earliest opportunity. The sooner we speak, the easier it is to capture all the details of your case and start working towards receiving the compensation you deserve.

Our initial free consultation will provide you with all the information you need to pursue your claim and, in cases where the healthcare provider has admitted liability, will allow us to request interim payments to help with any immediate costs you are incurring (e.g. medical costs, rehabilitation, travel to appointments etc.).

As well as confirming whether your Birth Injury relates to the negligence of the medical professionals, we can also give you an indication of the kind of compensation payment you may be likely to receive.

What will it cost to pursue my claim?

At BRM Legal we understand that this can be a very upsetting and emotional time and financial matters may not be your greatest concern. For this reason we are happy to take on your case on a No Win No Fee basis. This means that you will incur no costs unless your claim is successful*.

Even when you win your case, the majority of your legal expenses will be paid by the other side and any other costs will simply be deducted from your total compensation amount.

*Please note: This is subject to a No Win No Fee agreement having been signed with us (in conjunction with our insurers) and the terms of that agreement having been met by both parties.

How long do I have to make a claim?

As with any claim relating to medical negligence, a child has a right to claim (or have someone claim upon their behalf) any time until they are 18 years old and from this point the usual 3 year rule applies. If they have insufficient mental capacity to pursue a claim for themselves, they have an unlimited time to do so.

If the injury was to you as the mother then you must make your claim within 3 years of the negligent treatment.

How long will it take to receive compensation?

This depends on the individual circumstances of the case in question and whether the healthcare authority have admitted liability. The severity of you or your child’s condition and on-going recovery and rehabilitation needs will also be a factor in the time taken to reach a settlement as we want to ensure that we include every aspect of future needs in the final figure.

We will of course keep you updated throughout the process to tell you how your case is progressing and what the compensation total is likely to be.

Can I get help to access additional treatment and rehabilitation?

In the process of pursuing of your claim we will never forget that you have immediate needs and concerns. For that reason we will try to access funds to cover the additional costs you incur for treatment, further medical care, rehabilitation and also any adaptations or equipment you need in your home and immediate environment.

Our BRM Legal specialists can also liaise with your child’s support team to formulate a comprehensive care plan for the longer term. Having many years’ experience in this field we can provide helpful contacts such as support groups and charities who can offer further guidance and advice.
