What does the term ‘Birth Injury’ refer to?
A Medical Birth Injury is an injury caused to the mother or baby before, during or after the childbirth process – in this case due to a failure by the medical staff to provide the required and appropriate treatment and care.
What could be considered as a Birth Injury?
Examples of a Medical Birth Injury (in the case of the baby) could be:

Serious infections such as Group B Strep*
*Group B Strep is a type of bacteria called Streptococcus. It is very common, with as many as 2 in 5 people having it in their bodies. Whilst it is usually harmless (and most people who have it won’t actually know), it can be a problem during pregnancy and childbirth and there is a small risk of it spreading to the baby during labour, making them very ill.
How do I know if I have a claim?
It goes without saying that you and your baby should be taken care of during childbirth. If, however, mistakes have been made or standards have been very poor and an injury has been sustained, it is highly likely that the medical professionals failed to meet their Duty of Care. How do I make a claim?

How long do I have to make a claim?
As with any claim relating to medical negligence, a child has a right to claim (or have someone claim upon their behalf) any time until they are 18 years old and from this point the usual 3 year rule applies. If they have insufficient mental capacity to pursue a claim for themselves, they have an unlimited time to do so.
If the injury was to you as the mother then you must make your claim within 3 years of the negligent treatment.
How long will it take to receive compensation?
This depends on the individual circumstances of the case in question and whether the healthcare authority have admitted liability. The severity of you or your child’s condition and on-going recovery and rehabilitation needs will also be a factor in the time taken to reach a settlement as we want to ensure that we include every aspect of future needs in the final figure.
